ZONING BOARD OF APPEALS MINUTES
WEDNESDAY, MAY 26, 2010 - 6:30 P.M.
Chairman Mike Brownfield called a regular meeting of the City of Washington Zoning Board of Appeals to order at 6:30 p.m. in the Library meeting room.
Answering present for Roll Call were Board members Mike Brownfield, Steve Scott, Doug Weston, and Dick Rich. Louis Milot, Mike Burdette and Lori Weston were absent.
Also present was Building & Zoning Supervisor Becky Holmes, City Clerk Pat Brown, and petitioners Joseph and Mary Jacke.
Mr. Weston moved and Mr. Scott seconded to approve the minutes of the April 28, 2010 ZBA meeting as presented. Motion carried unanimously by voice vote.
Case No. 52610-V-1 - A public hearing was opened for comment on the request of Joseph and Mary Jacke, 412 Wilshire Court, for a fence variance to allow a 6' privacy fence to encroach into the front yard setback. Publication was made of the public hearing notice, and there were no "interested parties" registered.
B & Z Supervisor Holmes gave a brief overview of the variance request.
Petitioner comments: Joseph Jacke asked to amend his submitted site plan to show the fence extending to 26' from the front line of the house instead of the for 20' that is shown.
Audience comments: None.
Board comments: Mr. Scott asked what the distance would be if the neighbor on the corner at 410 Wilshire Drive wanted to install a 6' privacy fence in their side yard. B & Z Supervisor Holmes replied that they could go one half the distance from the side of the house to the property line.
The public hearing was closed at 6:38 p.m.
Mr. Scott moved and Mr. Weston seconded to approve the variance with an amended site plan that limits the fence from extending beyond the side line of the house at 410 Wilshire Drive.
Findings of Fact - application was made by owners of property; fees were paid; property is zoned R1; variance request to allow a 6' privacy fence to encroach into the front yard setback. A public hearing was held on Wednesday, May 26, 2010, all present were given the opportunity to be heard; there were no 'interested parties'; there were no objections to the granting of the variance; property cannot yield reasonable return because the fence backs into the rear yard of 410 Wilshire Drive; plight of the owner is due to unique circumstances because 410 Wilshire Drive could put the fence in the same location as a rear yard fence; character of the neighborhood will not be changed because the fence is on a cul-de-sac side yard which is the neighbors rear yard.

discussion and on roll call the vote was:

Nays: 0
Motion declared carried.
At 6:40 p.m. Mr. Scott moved and Mr. Rich seconded to adjourn. Motion carried unanimously by voice vote.
