ZONING BOARD OF APPEALS MINUTES
WEDNESDAY, APRIL 28, 2010 - 6:30 P.M.
Chairman Mike Brownfield called a regular meeting of the City of Washington Zoning Board of Appeals to order at 6:30 p.m. in the Library meeting room.
Answering present for Roll Call were Board members Mike Brownfield, Mike Burdette, Louis Milot, Dick Rich, Steve Scott, Doug Weston, and Lori Weston.
Also present was Building & Zoning Supervisor Becky Holmes and petitioners Jim Busch and Jamie Witt.
Mr. Milot moved and Ms. Weston seconded to approve the minutes of the October 28, 2009 ZBA meeting as presented. Motion carried unanimously by voice vote.
Case No. 42810-V-1 - A public hearing was opened for comment on the request of Faith Evangelical Lutheran Church, 650 School Street, for a sign variance to allow placement of a ground sign within the 12½ foot required setback from the front property line. Publication was made of the public hearing notice, and there were no "interested parties" registered.
B & Z Supervisor Holmes gave a brief overview of the variance request.
Petitioner comments: Jamie Witt indicated that the sign across the street from the daycare is 1' closer to the street than the requested sign will be. She added that if the sign were placed at the required setback it would be into the existing parking lot and that the daycare is suffering because of there being no signage.
Audience comments: No comments.
Board comments: Mr. Scott asked Jim Busch which sign option that they are going to go with and he replied the sign on the lower left of the handout that is 78" in height. Mr. Wilson asked if what is shown on the picture the final grade and Jim replied yes.
The public hearing was closed at 6:35 p.m.
Ms. Weston moved and Mr. Weston seconded to approve the variance as presented.
Findings of Fact - application was made by owners of property; fees were paid; property is zoned R2; variance request to allow placement of a ground sign within the 12½ foot required setback from the front property line, a 8½' variance is requested. A public hearing was held on Wednesday, April 28, 2010, all present were given the opportunity to be heard; there were no 'interested parties'; there were no objections to the granting of the variance; property cannot yield reasonable return because the business is not being recognized; plight of the owner is due to unique circumstances because the owner needs a sign to recognize the business; character of the neighborhood will not be changed because the sign will not alter the site line from the road.

discussion and on roll call the vote was:
Ayes: 6 Scott, Rich, Burdette, Brownfield, L. Weston, D. Weston
Nays: 0
Abstain: 1 Milot
Motion declared carried.
At 6:37p.m. Mr. Scott moved and Mr. Burdette seconded to adjourn. Motion carried unanimously by voice vote.
