CITY COUNCIL MEETING MINUTES
MONDAY, NOVEMBER 1, 2010 - 6:30 P.M.

Mayor Gary W. Manier called the regular meeting of Monday, November 1, 2010 to order at 6:30 p.m. in the meeting room at Washington District Library.

Present and answering roll call were Aldermen Brucks, Clanin, Howerter, Dingledine, Gee, and Schneider. Alderman Newman was absent.

Also present was City Attorney Ken Black, City Administrator Robert Morris, P & D Director Jon Oliphant, City Engineer Ken Newman, Public Services Manager Bill Bimrose, City Treasurer Ellen Dingledine, City Clerk Pat Brown, and members of the press.

All present stood for the Pledge of Allegiance.

The Agenda was reviewed and stood as presented.

Alderman Brucks moved and Alderman Howerter seconded to approve the Consent Agenda as presented. Items included on the Consent Agenda were minutes of the October 18, 2010 Council meeting and Police Pension Annual Report per House Bill 23. 
On roll call on the motion to approve the vote was: 
Ayes: 6 Clanin, Dingledine, Gee, Schneider, Howerter, Brucks 
Nays: 0 
Motion declared carried.

City Administrator Morris reported nothing on the agenda for the Finance & Personnel Committee. Alderman Dave Dingledine, Public Safety Committee Chairman reported nothing on the agenda. Alderman Al Howerter, Public Services Committee Chairman reported item B-1 under City Attorney on the agenda.

City Attorney Black read an ordinance, by title and brief synopsis, amending §75.10A entitled, "90-Day Load Limit on Certain Public Streets." Adoption of this ordinance will eliminate the special spring load limit restriction for North Cummings Lane north of US Route 24. This special weight restriction is no longer required as the newly reconstructed road has been designed and built to carry the normal weight limits, year round. Alderman Dingledine moved and Alderman Howerter seconded to adopt the ordinance as read.

City Attorney Black read an ordinance, by title and brief synopsis, authorizing the sale of certain personal property, designated as "Surplus Property." Adoption of this ordinance will authorize the disposition of surplus property by public auction. This property is no longer necessary or useful to the City of Washington. Alderman Dingledine moved and Alderman Schneider seconded to adopt the ordinance as read. 
On roll call the vote was:

Nays: 0

City Attorney Black provided first reading, by title and brief synopsis, of the following ordinance: an ordinance vacating a part of an alley located approximately 100 feet south of Walnut Street and west of Cedar Street. Adoption of this ordinance would vacate part of a 10-foot wide alley located approximately 100 feet south of Walnut Street and west of Cedar Street. This ordinance will be listed on the November 15th meeting agenda for action.

Mayor Manier reminded everyone of the Veteran's Day Celebration that is held at and sponsored by Deiters Funeral Home on Sunday, November 7th and the Mayor's prayer breakfast scheduled for Thursday, November 18th and encouraged everyone to attend these events.

Mayor Manier acknowledged receipt of Don Brubaker's resignation as Ward II Alderman. Don has relocated to East Peoria which moves him out of his Ward district.

Mayor Manier nominated Carol Moss, former City Clerk, to fill the unexpired term vacancy as Ward II Alderman. Alderman Gee moved and Alderman Clanin seconded to accept the nomination.

Nays: 0 
Motion declared carried.

Mayor Manier asked for the swearing in of Carol Moss as Ward II Alderman. City Clerk Pat Brown swore Alderman Moss into office.

Mayor Manier designated Alderman Moss to serve on the Public Safety Committee. Mayor Manier appointed Alderman Jim Gee to serve as Mayor Pro Tem. Former Alderman Don Brubaker served as Mayor Pro Tem until his recent resignation. Alderman Clanin moved and Alderman Schneider seconded to accept the appointment. On roll call the vote was: Ayes: 6 Brucks, Moss, Howerter, Dingledine, Schneider, Clanin Nays: 0 Abstain: 1 Gee Motion declared carried.

City Engineer Newman requested authorization to make full payment to Austin Engineering in the amount of $9,892.50 for additional engineering work that was performed to make revisions to the plans and easement and right-of-way documents regarding the Dallas Road reconstruction project. City Administrator Morris reported that all easements and right-of-way grants have been secured and the January letting is still on target. He noted that the project is still under budget by $10,000 for right-of-way purposes. Alderman Howerter asked what type of engineering inspection fees are expected and Engineer Newman replied that staff is still working this out and added that it is a federally funded and the city will meet all the documentation requirements. Alderman Gee moved and Alderman Howerter seconded to approve the request as presented.

City Engineer Newman requested authorization to enter into an agreement with Austin Engineering Company, Inc. to complete the engineering work for the third and final phase of the Devonshire trunk sewer upgrade project for an amount not to exceed $10,750.00. Alderman Brucks moved and Alderman Howerter seconded to approve the request as presented.

City Engineer Newman requested payment authorization to P. A. Atherton Construction, Inc. in the amount of $11,280.61 for their services in repairing the box culvert located southeast of the intersection of Kern Road and Wildwood Court. He went on to say it appeared that the creek bed had eroded about 18 inches since the installation of the culvert in 2004 creating the need for the repair. Alderman Gee asked if the original installation included rip rap and Newman replied yes, but it was blown out with the velocity of the creek water. The concrete which was put on top during the repair will help keep the rip rap in place and the culvert will now improve the efficiency of drainage in the area because it will now move much faster through the culvert. Alderman Dingledine moved and Alderman Howerter seconded to approve the request as presented.

Alderman Clanin shared that the WCHS Panther Volleyball Team won their regional by beating Limestone for the fourth time this season. They have earned the Mid-Illini Conference Title by beating Metamora and added that the team is doing well and the fans have shown great support.

At 6:56 p.m. Alderman Gee moved and Alderman Dingledine seconded to adjourn. Motion carried unanimously by voice vote.
