SUBJECT: 4 foot Side Yard Variance

PETITIONER: Aaron M. Nenne

LOCATION: 904 E Adams St

ZBA REQUEST: To allow a proposed garage to be 1 foot from the side property line. The required side yard setback for an accessory structure is 5 feet.

BACKGROUND: The property is zoned R-1 and has a lot width of 60 feet and a lot depth of 140 feet. The petitioner wishes to construct a 22 foot by 30 foot accessory garage. The property has a drive way extending to the side of the house but no garage. The proposed garage would be 1 foot from the property line but would leave a distance of 10+ feet to the neighbor’s garage.

STAFF’S OBSERVATIONS:

STAFF RECOMMENDATION: Staff recommends denial of the side yard variance.

SUBJECT: Variance to allow a message board sign within 100 feet of a residential district and to exceed 40% of the total sign area.

PETITIONER: Evangelical United Methodist Church

LOCATION: 401 Walnut Street

ZBA REQUEST: To allow the inclusion of a message board sign on the existing sign. The existing sign is within 100 feet of a residential district. The portion of the sign that the petitioner is requesting to change to a message board sign would exceed 40% of the total sign area by 6 ½%.

BACKGROUND: The property is zoned R-1 and is over an acre in size. The present use of the property is institutional. The petitioner is requesting to alter the existing sign by adding a message board sign in the portion that now has changeable letters.

STAFF’S OBSERVATIONS:

STAFF RECOMMENDATION: Staff recommends denial of the variance to include a message board sign on an existing sign.

PETITIONER: Donald E and Debra L McCollum

LOCATION: 600 Hilldale Ave

ZBA REQUEST: To allow a proposed garage to be 1 foot from the side property line. The required side yard setback for an accessory structure is 5 feet.

BACKGROUND: The property is zoned R-1 and has a lot width of 65 feet and a lot depth of 145 feet. The petitioner wishes to replace the deteriorated garage with a structure of similar size. The proposed structure will be 14 foot by 25 foot with an attached wrap-around storage area. The proposed garage would line up with the existing concrete driveway and the overhang would be 1 foot from the property line. Placement of the new garage would leave a distance of 15 feet to the principal structure.

STAFF’S OBSERVATIONS:

STAFF RECOMMENDATION: Staff recommends denial of the side yard variance.

ZBA REQUEST: To allow a proposed detached garage to be 2 foot from the side property line. The required side yard setback for an accessory structure is 5 feet.

BACKGROUND: The property is zoned R-1 and has a lot width of 86.8 feet and a lot depth of 154.4 feet. The petitioner wishes to replace the deteriorated garage with a structure that will be 18 foot by 20 foot. The proposed garage will be 2 foot 8 inches including overhang from the property line. Placement of the new garage would leave a distance of 24 feet to the principal structure.

STAFF’S OBSERVATIONS:

STAFF RECOMMENDATION: Staff recommends denial of the side yard variance.

ZBA REQUEST: To allow a proposed garage addition to be 1 foot from the side property line. The required side yard setback for an accessory structure is 5 feet.

BACKGROUND: The property is zoned R-1 and has a lot width of 60 feet and a lot depth of 153 feet. The petitioner wishes to construct an addition to the rear of the existing garage. The proposed addition will be 18 foot by 20 foot. The proposed addition would not encroach any farther into the side yard setback the existing structure.
